Introduction
This Fair Use Policy (“Policy”) outlines the acceptable use of the Car Lovers Express Infinity Wash Club (“Infinity Wash Club” or “Program”) by our customers. By participating in the Program, you agree to comply with this Policy. The Policy has been developed in compliance with Australian law and is intended to ensure that all customers can enjoy the benefits of the Program without interruption or inconvenience.
Scope
This Policy applies to all customers who subscribe to the Infinity Wash Club. The Infinity Wash Club is available as a Single, Double, or Triple Vehicle Membership, and may be billed on a weekly or monthly basis.
Membership Tiers
The Infinity Wash Club offers the following membership tiers. Each tier permits unlimited washes for the number of registered vehicles specified, subject to the Usage Restrictions below.
Single Membership: covers one (1) registered vehicle.
Double Membership: covers two (2) registered vehicles.
Triple Membership: covers three (3) registered vehicles.
Each vehicle covered under a Double or Triple Membership must be individually registered to the account.
Wash Type
The Infinity Wash Club is also available in two wash types: Basic Membership and Top Wash Membership. Basic Membership entitles the customer to Basic wash inclusions, and Top Wash Membership entitles the customer to Top Wash inclusions, as offered at the site where the wash is performed. Wash inclusions may vary by site. A Double or Triple Membership must be entirely Basic or entirely Top Wash – wash types cannot be mixed across vehicles registered to the same membership.
Billing Frequency
Members may elect to be billed weekly or monthly. Payment frequency can be selected at sign-up and changed at any time via the VIP Members Portal. Membership is continuous and automatically renews each billing period; billing will continue until the member cancels (see Cancellation below).
Failed Payments
If a payment fails, access to the Program will be suspended immediately. Car Lovers Express will attempt to collect the payment up to three more times over the following days. If payment still cannot be collected after the final attempt, the membership will be cancelled. You can re-join at any time via the VIP Members Portal.
Cancellation
Members may cancel their Infinity Wash Club membership at any time via the VIP Members Portal or by contacting Car Lovers Express. No cancellation fees apply. Following cancellation, the member retains access to the Program until the end of the billing period already paid for, after which no further payments will be deducted. No refunds are provided for any unused portion of a billing period, except where required by law.
Usage Restrictions
Vehicle Limit: Each membership tier covers only the number of registered vehicles specified for that tier (one for Single, two for Double, three for Triple). Customers are not permitted to use the Program for any vehicle not registered to their membership. Any attempt to use the Program beyond the registered vehicle(s) for the applicable tier may result in the immediate termination of the membership.
Fair Use Limit: The Infinity Wash Club is for reasonable personal use of each registered vehicle. Car Lovers Express monitors usage. If usage on a registered vehicle is well above normal personal use, we will contact you first. If the usage continues, we may suspend or cancel the membership. If we cancel for this reason, no further payments will be taken.
Site Access: The Infinity Wash Club can be used at any Car Lovers Express site.
Changing Membership Tier: Customers wishing to upgrade or downgrade their vehicle tier or wash type (e.g. from Triple to Single, or Basic to Top Wash) may do so via the VIP Members Portal or by contacting Car Lovers Express. Where a vehicle tier is downgraded, any vehicle no longer covered will immediately lose access under the Program.
Liability for Damage
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in this Policy limits those rights. Subject to those rights, Car Lovers Express is not responsible for damage caused by:
pre-existing damage or wear, including chipped or faded paint, failed clear coat and loose trim;
aftermarket or non-factory parts and accessories, including roof racks, aerials, bull bars, light bars, tonneau covers and wipers;
items left loose on or in the vehicle; or
not following site signage or staff instructions.
Please report any damage to site staff before leaving the site, or contact us as soon as possible, so we can review it.
Membership Termination
Car Lovers Express reserves the right to suspend or revoke a customer’s membership to the Infinity Wash Club if they do not abide by the terms of this Fair Use Policy. This includes, but is not limited to, attempting to use the Program for vehicles not registered to the membership (including exceeding the vehicle limit of the applicable tier), excessive or unreasonable usage, or using the Program in a manner that is fraudulent, abusive, or otherwise violates this Policy or any applicable laws.
Changes to the Policy
Car Lovers Express may update this Policy. We will give you at least 14 days’ notice by email of any change that affects your membership, including a change to your membership price. If you do not accept the change, you can cancel before it takes effect with no fee.
